APPLICANT PRIVACY NOTICE

1. PURPOSE AND SCOPE
Traditions Behavioral Health, Inc. and its applicable affiliates and related entities (“TBH,” “we,” “us,” or “our”) respect the privacy of individuals who seek employment or other professional opportunities with us.
This Applicant Privacy Notice (“Notice”) explains how TBH may collect, use, disclose, retain, and otherwise process personal information relating to individuals who apply for, express interest in, or are considered for employment or other professional opportunities with TBH (“Applicants”).
This Notice applies to Applicants for employment, physician and other healthcare professional positions, temporary or per diem positions, independent contractor or other professional engagements, and other opportunities for which TBH conducts recruiting, credentialing, screening, or onboarding activities.
It applies to personal information collected through:
- TBH’s career and recruiting websites;
- online application or applicant-tracking systems;
- email, telephone, and other recruiting communications;
- résumés, CVs, cover letters, and other application materials;
- interviews and recruiting events;
- referrals;
- professional networking and recruiting platforms;
- credentialing and verification processes;
- background-screening processes; and
- other lawful recruiting and employment-related activities.
TBH currently operates a recruiting platform through which prospective candidates may review opportunities and submit application materials.
This Notice does not create an employment contract or other contractual relationship between an Applicant and TBH.
2. RELATIONSHIP TO OTHER PRIVACY NOTICES
This Notice supplements TBH’s general Website Privacy Policy.
Where an Applicant is also a patient of TBH or an affiliated healthcare organization, information relating to the Applicant’s treatment or healthcare services may be governed by a separate Notice of Privacy Practices or other applicable healthcare privacy documentation.
This Notice is not a HIPAA Notice of Privacy Practices and does not replace any notice, authorization, consent, Business Associate Agreement, employment policy, or other documentation required under applicable law.
Where applicable law requires a more specific notice or disclosure, TBH will provide that notice separately.
3. CATEGORIES OF PERSONAL INFORMATION WE MAY COLLECT
The information TBH collects depends on the position, the stage of the recruiting process, the Applicant’s professional qualifications, and applicable legal and contractual requirements.
A. Contact and Identification Information
We may collect:
- name;
- preferred or former name;
- mailing address;
- email address;
- telephone number;
- location;
- professional contact information;
- date of birth, where reasonably necessary and legally permitted;
- government-issued identification information, where necessary for lawful employment, identity verification, credentialing, or screening purposes; and
- other information reasonably necessary to identify or communicate with an Applicant.
B. Application and Professional Information
We may collect information contained in:
- résumés;
- CVs;
- cover letters;
- applications;
- professional biographies;
- portfolios;
- employment histories;
- education records;
- training records;
- professional references;
- interview responses;
- professional correspondence; and
- other materials voluntarily submitted by an Applicant.
C. Healthcare Professional and Credentialing Information
For healthcare professionals, including physicians and other behavioral-health professionals, we may collect and verify information such as:
- professional license information;
- licensing jurisdiction;
- license status and expiration;
- specialty and subspecialty;
- board certification or eligibility;
- National Provider Identifier (“NPI”);
- Drug Enforcement Administration (“DEA”) registration, where applicable;
- Medicare or other government-program enrollment information;
- professional credentials;
- clinical privileges;
- education, residency, and fellowship information;
- clinical experience;
- professional affiliations;
- employment history;
- malpractice or professional liability information;
- disciplinary history;
- sanctions or exclusions;
- professional references;
- credentialing information; and
- information required by a client, facility, medical staff, payer, licensing authority, or regulatory organization.
TBH’s current job postings demonstrate that some positions may require professional qualifications and verification such as board certification, state licensure, NPI, DEA registration, and Medicare enrollment.
D. Background and Screening Information
Where applicable and permitted by law, TBH may collect information used for:
- identity verification;
- employment verification;
- education verification;
- reference checks;
- criminal background screening;
- professional-license verification;
- sanctions and exclusion screening;
- healthcare-program exclusion screening;
- drug testing;
- driving-record checks;
- professional disciplinary-history checks; and
- other legally permissible screening related to a particular position.
Certain background investigations may be conducted by third-party consumer reporting agencies or other service providers. Where required by applicable law, TBH will provide required disclosures and obtain required authorization before conducting such checks.
E. Employment Eligibility and Onboarding Information
If an Applicant advances in the hiring process or receives an offer, TBH may collect information necessary to complete legally required employment and onboarding processes, including information necessary to establish identity and authorization to work in the United States.
Additional information may be collected for payroll, benefits, tax, insurance, credentialing, licensing, compliance, or other employment-administration purposes.
4. INFORMATION WE RECEIVE FROM OTHER SOURCES
TBH may receive Applicant information from sources other than the Applicant, including:
- professional references;
- current or former employers;
- educational institutions;
- licensing boards;
- credentialing organizations;
- hospitals and healthcare facilities;
- government agencies;
- professional associations;
- background-screening providers;
- recruiting agencies;
- applicant referrals;
- job boards and professional networking services;
- publicly available professional sources; and
- TBH’s clients or prospective clients, where applicable and permitted by law.
We may combine information obtained from these sources with information provided directly by the Applicant.
5. INFORMATION YOU PROVIDE ABOUT OTHER PEOPLE
If you provide TBH with information about another individual, such as a reference, you should provide that information only when you are authorized to do so.
You should not provide unnecessary personal or sensitive information about another individual.
6. PURPOSES FOR WHICH WE USE APPLICANT INFORMATION
TBH may use Applicant information for purposes including:
Recruiting and Hiring
- identifying and evaluating candidates;
- processing applications;
- determining qualifications;
- communicating with Applicants;
- scheduling interviews;
- conducting interviews and assessments;
- evaluating candidates for current and future positions;
- making hiring and engagement decisions; and
- communicating offers or other employment-related information.
Professional Credentialing and Verification
- verifying licenses and certifications;
- confirming education and training;
- verifying professional experience;
- conducting credentialing and privileging activities;
- confirming eligibility to practice;
- satisfying client, facility, payer, regulatory, or professional requirements; and
- determining eligibility for specific clinical assignments.
Screening and Compliance
- conducting background checks;
- verifying employment and references;
- conducting sanctions and exclusion checks;
- complying with applicable healthcare requirements;
- satisfying client or facility requirements;
- protecting patient, employee, and workplace safety; and
- complying with applicable laws and regulations.
Employment Administration
For Applicants who become employees or contractors, information may additionally be used for:
- onboarding;
- payroll;
- benefits;
- scheduling;
- workforce administration;
- training;
- performance management;
- credentialing;
- compliance;
- workplace safety; and
- other employment-related purposes.
Business and Legal Purposes
TBH may also use Applicant information to:
- operate and improve its recruiting processes;
- maintain business and recruiting records;
- administer information systems;
- protect information and systems;
- detect and prevent fraud, misconduct, or unauthorized activity;
- investigate complaints;
- enforce agreements and policies;
- establish, exercise, or defend legal claims;
- respond to lawful requests;
- comply with legal and regulatory obligations; and
- protect the rights, safety, and property of TBH, Applicants, employees, patients, clients, and other individuals.
7. PROFESSIONAL OPPORTUNITIES WITH TBH CLIENTS
TBH provides behavioral-health and psychiatric services and staffing support to healthcare organizations and other entities.
Accordingly, an Applicant may be considered for an opportunity involving a TBH client, partner, healthcare facility, governmental organization, correctional healthcare program, residential program, hospital, outpatient program, or other organization.
When necessary and permitted by law, TBH may share relevant Applicant information with such organizations for purposes including:
- recruiting;
- evaluating qualifications;
- credentialing;
- privileging;
- licensing;
- background verification;
- onboarding;
- scheduling;
- contracting; and
- determining eligibility for a particular assignment.
TBH will seek to limit disclosures to information reasonably necessary for the applicable purpose.
8. TEXT MESSAGE COMMUNICATIONS WITH APPLICANTS
TBH may use text messaging as a communication channel for Applicants who provide a mobile telephone number and, where required, affirmatively opt in to receive text messages.
Depending on the Applicant’s stage in the recruiting process, TBH may use text messages for purposes including:
- acknowledging an application or inquiry;
- communicating about job opportunities;
- contacting Applicants regarding positions for which they may be qualified;
- interview scheduling and reminders;
- recruiter communications;
- requests for additional application information;
- credentialing communications;
- onboarding communications;
- employment-related administrative communications; and
- other recruiting or employment-related purposes described at the time of enrollment.
SMS Opt-In
Where required by applicable law, TBH will obtain prior consent before sending text messages to an Applicant.
An Applicant may opt in by checking an SMS consent box, submitting an applicable web form, replying to a text message, verbally providing consent where permitted, or using another method offered by TBH.
Where an Applicant opts in, the Applicant consents to receive text messages from TBH at the mobile telephone number provided for the specific messaging program identified at the time of enrollment.
Message and data rates may apply.
Consent to receive text messages is not a condition of applying for or obtaining employment with TBH.
Message Frequency
Message frequency will vary depending on the Applicant’s interactions with TBH and the nature of the recruiting or employment-related communications.
Opting Out of Text Messages
Applicants may opt out of TBH text messages at any time by replying STOP to a TBH text message.
Applicants may also contact their TBH recruiter or use another opt-out method provided by TBH.
After receiving an opt-out request, TBH will process the request in accordance with applicable law and its messaging procedures.
An Applicant may receive a single confirmation message confirming that the opt-out request has been processed.
Help
Applicants may reply HELP to a TBH text message for assistance or use the support contact information provided in the applicable SMS communication.
SMS and Recruiting Preferences
Opting out of text messages will not, by itself, withdraw an Applicant’s application or affect the Applicant’s eligibility for employment.
However, TBH may continue to communicate with Applicants through other available channels, including email or telephone, where appropriate and permitted.
Applicants may separately request that TBH discontinue other forms of recruiting communication.
Mobile Number Changes
Applicants should notify TBH if their mobile telephone number changes or is reassigned.
TBH may take reasonable measures to identify and remove numbers that are no longer associated with the consenting Applicant.
SMS Consent Records
TBH may retain records documenting an Applicant’s SMS consent, including the mobile telephone number, date and time of consent, method of consent, messaging program, and applicable opt-out requests.
These records may be retained for as long as reasonably necessary to administer the messaging program, demonstrate compliance, resolve disputes, and satisfy applicable legal or business requirements.
SMS Terms of Service
Text-message communications are also subject to TBH’s SMS Terms of Service. Applicants should review those terms before enrolling in a TBH text-message program.
9. SENSITIVE PERSONAL INFORMATION
Certain information collected during recruiting may be considered sensitive personal information under applicable law.
Depending on the position and circumstances, this may include:
- government identification information;
- professional license information;
- background-screening information;
- information relating to professional disciplinary history;
- information necessary to verify employment eligibility;
- information necessary to administer lawful employment processes;
- certain health-related information; and
- other information designated as sensitive under applicable law.
TBH will collect, use, and disclose sensitive personal information only as reasonably necessary for legitimate recruiting, employment, credentialing, compliance, security, legal, or other permitted purposes.
Applicants should not submit sensitive information that is not reasonably necessary for their application.
10. HEALTH-RELATED INFORMATION
TBH may collect limited health-related information when reasonably necessary and legally permitted for employment, occupational health, accommodation, credentialing, or other legitimate employment-related purposes.
For example, information may be requested in connection with:
- workplace accommodations;
- occupational-health requirements;
- legally permitted medical examinations;
- immunization or vaccination requirements;
- fitness-for-duty requirements;
- occupational exposure requirements; or
- other legally permitted employment requirements.
TBH will handle such information in accordance with applicable federal, state, and local law.
Applicants should not include patient medical information, protected health information (“PHI”), or information that identifies a patient in a résumé, CV, cover letter, application, or other recruiting submission.
If patient information is inadvertently provided, TBH may take reasonable steps to protect, segregate, delete, or otherwise handle that information in accordance with applicable law and TBH policy.
11. HOW WE DISCLOSE APPLICANT INFORMATION
TBH may disclose Applicant information to the following categories of recipients, as reasonably necessary and permitted by applicable law.
TBH Affiliates and Related Entities
Applicant information may be shared with TBH affiliates or related entities involved in recruiting, employment, credentialing, administration, or professional services.
Clients and Healthcare Organizations
Information may be disclosed to healthcare organizations and other entities for which an Applicant is being considered for a position, assignment, or professional engagement.
Service Providers
TBH may use third-party service providers for:
- applicant tracking;
- recruiting;
- background screening;
- credentialing;
- employment verification;
- document management;
- cloud hosting;
- information technology;
- cybersecurity;
- communications;
- scheduling;
- human resources;
- payroll;
- benefits;
- legal services; and
- other administrative functions.
Service providers will receive information only as reasonably necessary to perform services for TBH and subject to applicable contractual and legal requirements.
Professional and Regulatory Organizations
Where applicable, TBH may disclose information to licensing boards, credentialing bodies, medical staffs, professional organizations, governmental agencies, payers, accreditation organizations, or other entities involved in verifying professional eligibility.
Legal and Governmental Authorities
TBH may disclose information where required or permitted by law, including in response to:
- subpoenas;
- court orders;
- legal process;
- regulatory requests;
- governmental investigations;
- audits;
- reporting obligations; or
- other lawful requests.
Corporate Transactions
Applicant information may be transferred or disclosed in connection with an actual or contemplated merger, acquisition, financing, sale of assets, reorganization, bankruptcy, or similar transaction, subject to applicable law.
12. NO SALE OF APPLICANT INFORMATION
TBH does not sell Applicant personal information for monetary consideration.
TBH does not knowingly disclose Applicant personal information to third parties for purposes unrelated to recruitment, employment, professional engagement, legal compliance, or other legitimate business purposes except as described in this Notice or otherwise permitted by law.
Where applicable law defines certain advertising, sharing, or other disclosures as a “sale” or “sharing” of personal information, TBH will comply with applicable requirements.
13. AUTOMATED DECISION-MAKING AND ARTIFICIAL INTELLIGENCE
TBH may use technology-assisted tools in connection with recruiting, including systems that help organize applications, identify potentially qualified candidates, schedule communications, or administer recruiting workflows.
TBH does not intend for an automated system alone to make a final employment decision where applicable law requires human involvement.
Before publishing this Notice, TBH should confirm with HR, recruiting, IT, and counsel whether any artificial-intelligence or automated decision-making tools are currently used in the recruiting process and revise this section as necessary.
Where applicable law provides Applicants with rights relating to automated decision-making, profiling, or artificial intelligence, TBH will provide the notices and rights required by law.
14. DATA RETENTION
TBH retains Applicant information for as long as reasonably necessary for the purposes described in this Notice, subject to applicable legal, regulatory, contractual, and business requirements.
Retention periods may depend on:
- whether an Applicant is hired;
- the type of position;
- credentialing requirements;
- applicable employment laws;
- applicable healthcare regulations;
- client requirements;
- litigation or investigation holds;
- record-retention requirements; and
- other legitimate business needs.
If an Applicant is not selected for a particular opportunity, TBH may retain Applicant information for consideration for future opportunities where permitted by law.
TBH may also retain information when necessary to establish, exercise, or defend legal claims or to comply with legal obligations.
15. INFORMATION SECURITY
TBH maintains administrative, technical, and physical safeguards designed to protect Applicant information from unauthorized access, acquisition, use, disclosure, alteration, or destruction.
No method of electronic transmission or storage is completely secure. Accordingly, TBH cannot guarantee absolute security of information submitted electronically.
Applicants should exercise care when submitting information online and should not include unnecessary sensitive information in application materials or email correspondence.
16. THIRD-PARTY RECRUITING PLATFORMS
TBH may use third-party platforms to host job postings, accept applications, manage recruiting activities, conduct background checks, or perform other employment-related services.
When you interact directly with a third-party platform, that platform may independently collect and process information pursuant to its own privacy notice and terms.
TBH’s current career site is hosted through an external recruiting platform and includes application and candidate-submission functionality.
TBH is not responsible for the privacy practices of third parties to the extent those practices are outside TBH’s control.
17. YOUR PRIVACY RIGHTS
Depending on your state of residence and applicable law, you may have certain rights regarding your personal information.
These rights may include, subject to applicable limitations:
- the right to know or access certain personal information;
- the right to request correction of inaccurate information;
- the right to request deletion of certain information;
- the right to obtain information about categories of information collected, used, or disclosed;
- the right to obtain a copy of certain personal information;
- the right to opt out of certain forms of processing where applicable;
- the right to limit certain uses of sensitive personal information where applicable;
- the right to appeal a privacy-rights decision; and
- the right to nondiscrimination for exercising applicable privacy rights.
These rights are not absolute.
Applicable law may permit or require TBH to retain or process certain information notwithstanding a request for access, correction, deletion, or restriction.
Examples may include information necessary to:
- comply with law;
- satisfy employment or credentialing obligations;
- protect security;
- prevent fraud;
- establish or defend legal claims;
- complete a lawful employment process;
- maintain legally required records; or
- protect the rights and safety of others.
18. CALIFORNIA APPLICANTS
If you are a California resident, the California Consumer Privacy Act, as amended (“CCPA”), may provide additional rights regarding personal information, subject to applicable exemptions and limitations.
Certain personal information collected in the employment context may be subject to special treatment or exemptions under California law.
To the extent applicable, California Applicants may have rights regarding:
- access;
- correction;
- deletion;
- information about categories of personal information collected, used, or disclosed;
- information about categories of sources and recipients;
- and other rights provided under applicable California law.
TBH will provide any additional notices and honor applicable rights required under California law.
19. APPLICANTS IN OTHER STATES
Other states may provide Applicants with additional privacy rights.
Examples may include state comprehensive privacy laws governing access, correction, deletion, portability, appeals, or opt-out rights.
TBH will comply with applicable state privacy laws to the extent those laws apply to TBH and the relevant Applicant information.
Where required, TBH may provide a state-specific privacy supplement or additional notice.
20. EQUAL EMPLOYMENT OPPORTUNITY AND PRIVACY
TBH is committed to complying with applicable federal, state, and local employment laws.
Applicant information may be processed as necessary to administer lawful employment, equal employment opportunity, accommodation, compliance, and workforce-management programs.
TBH does not intend to use Applicant information in a manner that violates applicable anti-discrimination laws.
Nothing in this Notice limits an Applicant’s rights under applicable employment or anti-discrimination laws.
21. ACCURACY OF APPLICANT INFORMATION
Applicants are responsible for providing accurate and complete information.
Applicants should promptly notify TBH if information relevant to their candidacy changes, including:
- contact information;
- professional licenses;
- certifications;
- employment status;
- professional credentials;
- availability; or
- other material qualifications.
Providing materially false, misleading, or incomplete information may affect an Applicant’s candidacy or eligibility for employment or professional engagement.
22. CHILDREN
TBH’s recruiting activities are directed toward individuals who are legally eligible to seek employment or professional engagement.
TBH does not knowingly collect personal information from children through its recruiting systems except where legally permitted and necessary for a legitimate purpose.
23. INTERNATIONAL APPLICANTS
TBH primarily conducts its operations in the United States.
If an Applicant accesses TBH recruiting systems from outside the United States, information may be transferred to and processed in the United States or other locations where TBH or its service providers operate.
Applicants located outside the United States should understand that privacy protections may differ from those in their country of residence.
24. CHANGES TO THIS NOTICE
TBH may update this Notice from time to time to reflect changes in:
- recruiting practices;
- technology;
- service providers;
- applicable law;
- business operations; or
- privacy practices.
The “Last Updated” date at the top of this Notice indicates when the Notice was most recently revised.
Material changes will be communicated in accordance with applicable law.

26. APPLICANT ACKNOWLEDGMENT
Where presented during the application process, Applicants may be asked to acknowledge that they have received or had an opportunity to review this Notice.
An acknowledgment of this Notice does not:
- constitute an employment agreement;
- guarantee employment;
- constitute consent where consent is not legally required;
- waive rights provided by applicable privacy law; or
- limit rights that cannot lawfully be waived.
TBH will obtain separate authorization or consent where required by applicable law.
